Spain Entrepreneur Residence Renewal: Documents, ENISA and Your Options

If you moved to Spain with an entrepreneur residence permit, renewal is a good time to review both your paperwork and the direction of your business. Your application should explain what the project has achieved, how it has changed and what comes next. This guide brings together a preparation checklist, suggestions for presenting your business progress and alternatives to consider if your work now centres on remote employment or international freelance clients. Although commonly called a “startup visa renewal”, the process concerns the renewal of your entrepreneur residence authorisation — renewing the physical TIE card is a separate step.

What does entrepreneur residence renewal involve?

Spain’s entrepreneur residence route operates under Law 14/2013. It concerns innovative business activity of particular economic interest to Spain, with ENISA assessing the entrepreneurial project and UGE handling the residence application. The law provides for a two-year renewal after the initial authorisation, subject to the applicable requirements.

For preparation, think of your file as two connected parts: the residence documents and the evidence explaining how your business has developed. Make sure the figures, dates and descriptions agree across both.

Personal and application documents

Use this as a working checklist to discuss with your adviser. The exact documents depend on your business structure, filing obligations and the instructions for your application.

Do not assume a document is unnecessary simply because another applicant was not asked for it. Check the current requirements and any individual request from UGE, including requirements concerning financial resources or personal documentation.

  • Valid passport — a complete, legible scan.
  • Current TIE — scan of both sides of your residence card.
  • Application form — the current MI-T form, with the appropriate procedure selected and signed where required.
  • Application fee — the relevant Modelo 790, code 038, with proof of payment. Check the applicable fee category and amount before paying.
  • Business update — your project explanation and supporting evidence for the assessment process.

Company documents if you operate through an SL

If your project operates through a Spanish limited company, ask your gestor to review the availability of the documents below.

Check that certificates identify the correct company: an individual certificate and a company certificate refer to different taxpayers or registered entities. If a requested tax return was not due or your company was exempt from filing it, ask your gestor to document the reason and identify suitable supporting evidence — avoid leaving the gap unexplained.

  • Latest annual accounts filed with the Commercial Registry, together with the filing receipt.
  • Latest Modelo 347, where your company is required to submit this annual declaration of transactions with third parties.
  • A current company tax compliance certificate from the Agencia Tributaria.
  • A current company Social Security compliance certificate from the Tesorería General de la Seguridad Social.

What if your company has no employees?

Ask your gestor how to obtain evidence of the company’s Social Security position for its actual registration status. If an online certificate cannot be generated, establish why and how to document that situation.

When registration details need correcting, use the company’s real activity, applicable insurance arrangements and employment information. Do not copy activity codes or collective agreement selections from someone else’s application merely to get through an online form.

Preparing your ENISA business update

Start with the business plan used for your original application, then write an update that makes the project’s development easy to follow.

Support the narrative with documents you can substantiate: contracts, invoices, product demonstrations, financial records and dated milestones. Explain how your own role has evolved, particularly if the project has several founders.

A business pivot needs a clear explanation. Show the relationship between the original project and the current activity, the evidence behind your decision and how the revised plan will work. Awards, press coverage and accelerator participation can add context, but present them alongside evidence of business activity rather than in place of it.

Follow the current ENISA process associated with your residence application. If your existing account does not allow the required submission, confirm the procedure with support before creating another account.

  • Original plan: what you intended to build, who your customers were and how you expected to earn revenue.
  • Work completed: product development, launches, customer research, partnerships and operational milestones.
  • Results: revenue, paying customers, usage, contracts or other relevant evidence.
  • Changes: what did not work, what you changed and why.
  • Next steps: a realistic plan and financing assumptions for the next two years.

Do you need to open an SL before renewing?

Review the legal and operating structure of your actual project before making that decision. Incorporating a company is a business decision with ongoing accounting, tax and administrative obligations.

If you currently operate as an autónomo, ask how your activity and supporting records should be presented for the entrepreneur route. Opening an SL shortly before renewal does not, by itself, demonstrate the development of a qualifying project.

If incorporation is appropriate, compare the complete cost: notary and registration fees, certificates, accounting, administrator obligations and ongoing banking charges. Request a written quote that separates initial costs from recurring services.

Timing and application preparation

Start gathering company records and drafting the business update well before your permit expires. Confirm the applicable renewal window and plan your submission around it.

Do not use another applicant’s processing time as a deadline guarantee. Leave room for document preparation and requests for additional information, and arrange access to electronic notifications while travelling.

  • Names and identification numbers are consistent throughout the file.
  • Scans are complete and readable.
  • Forms are signed and payment evidence is included.
  • Financial figures match the supporting records.
  • Any missing or inapplicable document is explained.
  • You or your representative can monitor the application and respond promptly.

Could digital nomad residence be a better fit?

If your current work mainly involves remote employment or freelance services for overseas clients, Spain’s digital nomad residence route may be worth assessing.

For remote employees, the work must be for companies based outside Spain. Self-employed professionals may work for Spanish companies within the limit of 20% of their total professional activity — so a blanket statement that all digital nomads are prohibited from having Spanish clients is incorrect.

Eligibility also involves requirements concerning the work relationship, qualifications or experience, financial resources and Social Security coverage. Switching from entrepreneur residence requires its own assessment and application; it is not automatic. Prepare that assessment before your current permit expires — waiting for a renewal refusal can leave less time to evaluate your lawful status and available options.

Other residence options and tax considerations

A self-employed residence and work route (cuenta propia) may also deserve consideration if it fits your activity. Confirm whether a change is available from your current status and which requirements apply. Maintaining an autónomo registration alone should not be treated as a guarantee of eligibility or renewal.

If you use the special tax regime commonly called the Beckham Law, review the consequences of any change in your work or residence circumstances with a tax adviser. The relevant question is whether you continue to meet the regime’s conditions; Modelo 149 is used for notifications, including exclusion from the regime.
