Spain Digital Nomad Visa: How to Prepare a Remote Work Authorization Letter

Your contract says your job is remote. Does your employer also allow you to do that job while living in Spain? Before preparing your application, get a clear answer in writing. A useful employer letter makes the arrangement easy to understand: who employs you, what you do, where you are allowed to work, and which terms apply. This guide covers employees of foreign companies. It is a document-preparation guide, not an official government form. Requirements checked on 5 September 2026.

What the law requires

Article 74 ter of Law 14/2013 requires evidence that the work can be performed remotely and that the foreign employer permits remote work. It also requires an employment relationship covering at least the three months before the application, and at least one year of real, continuous activity by the company or group.

The structure below is our practical drafting recommendation. It is not a statutory list of mandatory letter fields, and no single document guarantees that every evidential requirement is satisfied.

What to ask HR to include

Send HR one request with the information you need, rather than asking for a general “visa letter.” Writing “remote employee” leaves the location unclear; writing “authorized to work remotely from Spain” answers the question directly — and the employer must be able to stand behind that statement.

  • Employer identity: legal company name, registration country, registered address and registration number — compare with the company extract and contract.
  • Employee identity: full legal name and job title — compare with passport and employment documents.
  • Employment history: actual start date and confirmation that employment continues.
  • Work from Spain: explicit permission to perform the role remotely from Spain.
  • Role and working method: a short description of duties and how they are performed remotely.
  • Duration: the actual period of the arrangement, or an accurate explanation if it is open-ended.
  • Pay: amount, currency, payment frequency and whether the figure is gross.
  • Signatory: name, position, signature, date and business contact details.

Editable employer letter example

This is an original drafting example. Replace every bracketed field, remove inapplicable wording and have the employer approve the final text. The example does not establish tax or social security compliance.

“[Company letterhead] — Date: [day month year] — Subject: Remote work authorization — [employee’s full name]”

“We confirm that [employee’s full name] has been employed by [company’s legal name], registered in [country] under registration number [number], since [employment start date]. The employee currently holds the position of [job title].”

“The company authorizes [employee’s name] to perform this role remotely from Spain during [accurate dates or description of the approved arrangement].”

“The employee’s duties include [brief factual description]. These duties will be performed using [relevant software, communication tools and working arrangements]. [Explain any location or attendance conditions accurately.]”

“The employment contract is [indefinite / fixed-term until date]. Current remuneration is [amount and currency], paid [frequency], stated on a [gross / net] basis. [Describe any variable component separately.]”

“For verification of this letter, please contact [name, position, business email and telephone]. [Signature] — [Signatory’s full name and position] — [Company’s registered address]”

If a sentence is untrue, change the arrangement or change the wording. Do not add a three-year commitment, remove an attendance obligation or describe variable compensation as guaranteed simply to make the letter appear stronger.

Check the letter against the rest of your file

Before asking for the final signature, place the draft next to your contract and payroll records and look for differences a reviewer would have to resolve.

A hypothetical example: a contract might allow home working only within the employer’s country. A later letter authorizing Spain should address that restriction clearly. If the contract needs changing, ask HR to document the change rather than leaving two conflicting statements in the application.

  • Does the letter name the same legal employer, rather than only a trading brand?
  • Does it use the correct start date, including any relevant contract changes?
  • Are the salary amount, currency and payment frequency consistent?
  • Does the contract contain a workplace restriction that still needs an amendment?
  • Does the signatory describe the actual role rather than a generic remote position?

What if you are a contractor?

Do not ask a client to certify that you are its employee if you are an independent contractor. Use documents that accurately describe the commercial relationship, services, payment terms and remote arrangement. The employee example above should not be reused unchanged.

Translation and other supporting documents

Confirm the translation and document-formality requirements for your filing route before ordering work. A letter written in English is a drafting starting point; this article does not establish that it can be submitted untranslated.

Treat company evidence, qualifications, income and social security as separate preparation tasks. A clear employer letter helps explain the working arrangement, but it should not be used to claim that those other checks have already been completed.
